These Terms of Service (the "Terms") govern access to and use of www.fromtheandes.net and the products, content, features, and services made available through the website (collectively, the "Services"). The Site is operated by From The Andes Inc. References to "From The Andes," "we," "us," and "our" mean From The Andes Inc.

By using the Services or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, do not use the Services. Nothing in these Terms limits any consumer right or remedy that cannot be waived under applicable law.

1. Eligibility and Customer Information

You may browse the Site regardless of age. To place an order, you must have reached the age of majority in your jurisdiction or have permission and supervision from a parent or legal guardian who accepts responsibility for the order.

You agree to provide current, complete, and accurate order, payment, billing, shipping, and contact information. You are responsible for maintaining the confidentiality of any customer-account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.

2. Permitted Use of the Site

From The Andes Inc. grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, lawful shopping and informational purposes. No ownership right in the Site or its content is transferred to you.

We may restrict or terminate access when reasonably necessary to address a violation of these Terms, suspected fraud, abuse, unlawful conduct, threats to security or safety, interference with the Services, or a legal requirement. Any restriction or refusal of service will be exercised subject to applicable law.

3. Products and Product Information

From The Andes Inc. offers a varied catalog that may include contemporary apparel, jewelry, accessories, home decor, sculpture, handmade merchandise, vintage merchandise, one-of-a-kind artifacts, and limited editions. Product classifications apply only when stated in the applicable product listing or order documentation.

We make reasonable efforts to present product descriptions, materials, measurements, photographs, prices, availability, condition, provenance, and other information accurately. Product information may be corrected when an error is identified.

Colors and visual details may appear differently depending on the customer's screen, lighting, browser, or device. Handmade and natural-material products may show variations in weave, texture, grain, form, color, or finish. Vintage and previously owned items may show age-related wear or imperfections. When material variations or condition characteristics are accurately photographed or disclosed, they are part of the product's stated character and are not necessarily defects.

This section does not excuse a material misdescription, undisclosed damage, incorrect fulfillment, or failure to satisfy a mandatory consumer guarantee.

4. Availability, Order Review, and Acceptance

Products may be available in limited quantities, including one-of-a-kind inventory. Adding an item to a cart does not reserve it. We may establish reasonable purchase limits and may discontinue a product at any time.

An order is subject to payment authorization, inventory verification, destination eligibility, fraud screening, and legal or carrier restrictions. We may decline or cancel an order before shipment because of unavailable inventory, a material pricing or product-information error, suspected fraud, an invalid payment, a shipping restriction, or another lawful operational reason.

If we cancel a paid order before shipment, we will promptly refund the amount collected for the canceled merchandise and any associated shipping charge collected for that order.

5. Pricing, Currency, and Payment

Prices are displayed in United States dollars unless the Site expressly states otherwise. Prices may be changed prospectively at any time. A price change does not alter the price of an order already accepted, except when correction is required by law or the customer agrees to the change.

Payments are processed through Shopify and supported third-party payment providers. Available payment methods are displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.

6. Shipping and Delivery

From The Andes Inc. accepts and ships orders to eligible addresses within the United States and supported U.S. territories, including Alaska, Hawaii, Puerto Rico, supported U.S. territories and possessions, and eligible APO, FPO, and DPO addresses.

Shipping origin, handling time, carrier service, the complimentary Ground-to-Priority upgrade, transit estimates, tracking, and delivery procedures are governed by our Shipping Policy, which is incorporated into these Terms.

Orders typically ship within 1 business day. Orders placed after 12:00 p.m. Mountain Time typically ship the following business day. Handling time is separate from carrier transit time.

USPS Priority Mail currently has a 2–3 business day service objective after USPS acceptance and is not a guaranteed delivery service. A carrier estimate is not a guaranteed delivery date unless the selected service expressly includes a delivery guarantee.

7. Returns, Exchanges, Refunds, and Store Credit

Our voluntary return program is governed by our Returns and Refunds Policy, which is incorporated into these Terms.

All products may be returned within 30 calendar days after delivery, subject to the merchandise condition and authorization requirements in the Returns and Refunds Policy.

An eligible voluntary return may receive a refund of the merchandise price to the original payment method, an exchange, or store credit. Approved U.S. returns receive a prepaid return label paid by From The Andes Inc. We do not charge a restocking fee for an approved return that meets the policy.

Approved refunds are initiated within 3 business days after inspection. From The Andes Inc. pays outbound shipping for an approved exchange.

Mandatory consumer rights take priority over any inconsistent product-specific statement, warranty disclaimer, or condition term.

8. Prohibited Conduct

You agree not to:

  • Use the Services for an unlawful, fraudulent, abusive, or misleading purpose.
  • Violate the intellectual-property, privacy, publicity, contractual, or other rights of another person.
  • Submit false order, payment, identity, billing, shipping, review, or account information.
  • Introduce viruses, malware, malicious code, or other harmful technology.
  • Interfere with the operation, availability, integrity, or security of the Services.
  • Attempt to gain unauthorized access to an account, server, network, database, or system.
  • Circumvent access controls, purchase limits, fraud controls, or security measures.
  • Use automated systems to scrape, harvest, reproduce, index, or extract Site content without written permission, except where applicable law expressly permits the activity.
  • Use Site content to build or train a commercial dataset, machine-learning system, or competing catalog without written permission, except where applicable law expressly permits the activity.
  • Impersonate another person or misrepresent an affiliation with From The Andes Inc.

9. Intellectual Property

The Site and its original text, product photography, graphics, logos, branding, layouts, and other content are owned by From The Andes Inc. or used with permission from the applicable rights holder. They are protected by copyright, trademark, and other applicable laws.

You may use the Site only as expressly permitted by these Terms. Without prior written permission, you may not reproduce, republish, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit protected Site content. Rights belonging to artists, photographers, licensors, cultural organizations, payment providers, Shopify, or other third parties remain with their respective owners.

FROM THE ANDES, associated logos, and other brand identifiers used on the Site may not be used in a manner that suggests sponsorship, endorsement, affiliation, or source without written permission.

10. Reviews, Messages, and Customer Submissions

If you voluntarily submit a review, comment, photograph, message, suggestion, or other content through the Services, you represent that you have the right to submit it and that it does not violate another person's rights or applicable law.

You grant From The Andes Inc. a non-exclusive, worldwide, royalty-free license to store, reproduce, format, and display that submission as reasonably necessary to operate the Services, respond to you, provide customer support, and display customer reviews. We will not use a customer's private message or personally identifying photograph in advertising without permission, except as otherwise disclosed in the Privacy Policy or permitted by law.

We may remove or decline to publish content that is unlawful, fraudulent, threatening, infringing, irrelevant, deceptive, contains personal information, or violates these Terms. We do not promise to publish every submission.

11. Third-Party Services and Links

The Services rely on third parties such as Shopify, payment providers, shipping carriers, analytics providers, and other service providers. Some Site features or links may lead to third-party websites or services governed by their own terms and privacy practices.

From The Andes Inc. does not control an independent third party's website, systems, availability, content, or conduct. This section does not excuse From The Andes Inc. from obligations it owes directly to a customer under an order, these Terms, an incorporated policy, or applicable law.

12. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy available through the Site footer and checkout. Site operations require the processing of information as described in that policy and under applicable law.

13. Service Availability

We work to maintain an accurate and available Site, but we do not guarantee that every Site feature will be uninterrupted, error-free, secure, or available at every time. We may correct errors, perform maintenance, update features, or suspend part of the Services when reasonably necessary.

A temporary Site interruption does not alter an accepted order or eliminate a refund, delivery, privacy, consumer-protection, or other obligation that applies independently.

14. Product Warranties and Disclaimers

Except for express promises stated in a product listing, these Terms, or an incorporated policy, the Site and its informational content are provided on an "as available" basis to the fullest extent permitted by law.

A vintage item, one-of-a-kind artifact, or other product may be sold in its accurately disclosed condition. Accurately disclosed age, wear, natural variation, or condition characteristics do not excuse fraud, material misdescription, undisclosed damage, incorrect fulfillment, or a consumer guarantee that cannot legally be excluded.

To the fullest extent permitted by law, we disclaim implied warranties that may lawfully be disclaimed. We do not disclaim or restrict warranties, guarantees, remedies, or liabilities that applicable law does not permit a business to exclude.

15. Limitation of Liability

To the fullest extent permitted by law, From The Andes Inc. and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services when such damages may lawfully be excluded.

For a claim that may lawfully be limited, the aggregate liability of From The Andes Inc. will not exceed the amount the customer paid for the product or Service directly giving rise to the claim.

These limitations do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of a mandatory consumer guarantee, a legally required refund or replacement, or another liability that cannot be excluded or limited under applicable law.

16. Events Outside Reasonable Control

From The Andes Inc. is not responsible for a delay or failure caused by an event outside its reasonable control, including natural disasters, severe weather, war, civil disorder, government action, carrier disruption, labor disruption, utility failure, or widespread internet or payment-network failure.

We will take reasonable steps to communicate material delays and reduce their impact. This section does not eliminate a customer's right to cancel an unshipped delayed order, receive a required refund, or exercise another right provided by law.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles, except when mandatory law requires another result.

Subject to any consumer right to bring a claim in another available forum, disputes relating to these Terms or the Services may be brought in the state courts serving Taos County, New Mexico, or the United States District Court for the District of New Mexico, when that court has jurisdiction.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or restricts a consumer right that cannot be waived by contract.

18. Changes to These Terms

We may revise these Terms prospectively to reflect changes in the Services, business operations, law, or risk controls. The revised Terms will be posted with an updated effective date. A material revision will not retroactively change the terms governing an order placed before the revision unless the customer agrees or the change is required by law.

Continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms for future Site use. The terms and policies in effect when an order is placed generally govern that order.

19. Severability, Waiver, and Assignment

If a provision of these Terms is found unenforceable, it will be enforced to the greatest extent permitted or modified only as much as necessary, and the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent. From The Andes Inc. may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the business, subject to applicable law and continued protection of customer rights.

20. Entire Agreement and Policy Priority

These Terms, the product listing, the final checkout disclosures, the Shipping Policy, the Returns and Refunds Policy, and the Privacy Policy constitute the agreement governing a purchase.

If these Terms conflict with the Shipping Policy or Returns and Refunds Policy on a subject specifically governed by that policy, the applicable policy controls for that subject. Mandatory law controls over every conflicting provision.
